Public Hearing scheduled on the Town of Montezuma’s opt-0ut option to allow adult-use marijuana retail dispensaries or on-site consumption licenses

The Town of Montezuma will hold a public hearing to give the opportunity for residents to discuss options for the Town under a new NYS law passed on March 31, 2021. The Marijuana Regulation and Taxation Act legalizes adult-use of cannabis (known as marijuana or recreational marijuana) in NYS.

While this new state law allows for the possession and use of cannabis by adults over 21 years of age or older, municipalities can opt-out of allowing adult-use cannabis retail dispensaries or on-site consumption licenses from location with their jurisdictions under this law. To opt-out a municipality must pass a law by December 31, 2021.

Several local communities have held public meetings regarding the new law and this is an opportunity for residents to give their input. If municipalities don’t opt out by December 31, 2021, the municipality will not be allowed to opt out at a later date. However, at any time a municipality may opt back in to allow adult use retail dispensaries and/or on-site consumption.
